TERMS OF USE AND CONDITIONS

These Terms of Use and Conditions establish the rules and guidelines for the use of the Bagaer application (“Bagaer”), developed and made available by Bagaer Trips Tecnologia Ltda, registered with CNPJ 52.084.568/0001-31, headquartered in Jaú, state of São Paulo, Brazil. By using the Bagaer application, the user declares that he/she has read, understood and fully agrees with the conditions set forth herein.

PURPOSE

Bagaer offers a baggage registration and tracking service, generating an authenticated and encrypted digital document that can be used to validate the ownership and integrity of checked baggage. The purpose of using the application is to assist passengers and airline agents in cases of problems with baggage.

USER RESPONSIBILITY

2.1. By using Bagaer, the user declares that the information entered in the application is true and complete, assuming full responsibility for any incorrect or incomplete data that may impact the use of the service.
2.2. The user is responsible for keeping his/her device secure and ensuring that third parties do not access his/her information in the application without authorization.

DISCLAIMER

3.1. Bagaer is not responsible for loss, damage, theft or any other problem related to baggage or transported objects.
3.2. The responsibility for the transportation, integrity and care of baggage is the sole responsibility of the airlines and their third-party agents (Handling Agents).
3.3. Bagaer does not offer and does not undertake to provide compensation for any problems with the user's baggage.

SERVICE FUNCTIONALITIES

4.1. Bagaer offers passengers free of charge:

  • Secure and encrypted registration of baggage information;

  • The generation of a digital document with a Bagaer authentication seal, ensuring the veracity of the information;

  • Tools to assist in the identification and tracking of baggage.

4.2. The digital document generated by Bagaer can be used in:

  • Complaints and requests to airlines or third-party agents;

  • Communication with regulatory and government agencies;

  • Submission as evidence in administrative or legal proceedings related to baggage;

  • Assistance to police authorities in cases of fraud, theft or tag swapping.

PURPOSES AND BENEFITS OF THE AUTHENTICATED DOCUMENT

5.1 The purpose of Bagaer is to:

  • Provide greater peace of mind to passengers regarding the integrity and ownership of their baggage;

  • Help airlines and agents in the process of searching for and identifying baggage;

  • Serve as evidence in cases of tag swapping, fraud or tampering with baggage;

  • Facilitate the process of compensation for loss or misplacement, helping to define the fair amount of compensation between the passenger and the airline;

  • Prove ownership and the passenger's connection to the baggage, based on the data registered before boarding.

PRIVACY AND SECURITY OF INFORMATION

6.1. Bagaer undertakes to store baggage data in a secure and encrypted manner, ensuring the confidentiality and integrity of the information.
6.2. Bagaer may share information only with the user's authorization or by court order, in order to collaborate with administrative, judicial or police investigations.
6.3. By using the application, the user agrees that his/her information may be used in an anonymous form for analysis and statistical studies, especially to improve the service and provide reports to the market and authorities.

LIMITATIONS OF USE

​7.1. Bagaer is a complementary tool and does not replace the responsibility or obligation of airlines and their agents in the transportation and handling of baggage.
7.2. Under no circumstances shall Bagaer be held liable for failures in transportation, loss, damage, theft, or any inconvenience suffered by the user.

CHANGES TO THE SERVICE AND TERMS

8.1. Bagaer reserves the right to change, modify or discontinue any part of its services at any time, without prior notice.
​8.2. These Terms of Use may be changed at any time. The user will be informed of any changes through the application or other communication channels made available by Bagaer.

ACCEPTANCE OF THE TERMS

9.1. By using the application, the user declares that he/she fully agrees with these Terms of Use and acknowledges that Bagaer is exempt from any liability related to the transportation of baggage.

APPLIABLE LEGISLATION AND JURISDICTION

10.1. This Term of Use is governed by and construed in accordance with Brazilian law.
10.2. For the resolution of any disputes arising from this Term, the jurisdiction of the District of Bauru, State of São Paulo, is elected, waiving any other, however privileged it may be.
